Federal Court Gives Texas and Louisiana OK to Drop Planned Parenthood from Medicaid Funding

A federal court has ruled that Texas and Louisiana have the right to bar Medicaid funding from going to abortion mill operator Planned Parenthood.

The Fifth U.S. Circuit Court of Appeals ruled in an 11-5 majority that the states have a right to decide where their Medicaid funding goes. The Appeals Court overturned a lower court ruling that maintained that the states did not have that right after Planned Parenthood sued over decisions to cancel the funding they had been receiving from state Medicaid programs.

Medicaid beneficiaries “have no right under the statute to challenge a State’s determination that a provider is unqualified,” the court wrote. Since the patients — nor the abortion mill — have standing to tell the states how to run their Medicaid programs, the court ruled that the states could eliminate Planned Parenthood as a beneficiary.

The recent move to defund Planned Parenthood comes on the heels of the group being dropped from federal Title X funding because the Trump administration changed the rules to exclude the funding from going to abortions.

However, Planned Parenthood claimed that they should continue to get federal dollars because of the “other” health services they provide. The truth is, of course, that Planned Parenthood does not offer any service other than abortion. Their claims to the contrary notwithstanding, nearly all their services are centered around abortion.

Texas attorney general Ken Paxton celebrated the Appeals Court’s ruling.

“The Fifth Circuit correctly rejected Planned Parenthood’s efforts to prevent Texas from excluding them from the state’s Medicaid program,” Paxton said in a statement. “Undercover video plainly showed Planned Parenthood admitting to morally bankrupt and unlawful conduct, including violations of federal law by manipulating the timing and methods of abortions to obtain fetal tissue for their own research.”

This victory for life may be short lived. There is no telling what the incoming Biden administration (if he actually wins the election) may do to restore federal dollars going to the murder of babies.
