Chances are, U.S. District Judge David J. Hale of the Western District of Kentucky, believes that if someone tells you to jump off a bridge and you do it, that it’s the fault of the person telling you to jump in the first place. Or the one many of us heard from a teacher that if all the others kids poked themselves in the eye with a pencil, would we also poke ourselves in the eye with a pencil?
Virtually all of us remember hearing something like that from our teachers in school or our parents when we were kids, but obviously Judge Hale never had such wise or caring teachers or parents.
Why the put down or questioning of Judge Hale’s up-bringing?
He has just ruled that a lawsuit against Donald Trump would be allowed to move forward in the courts. The lawsuit was filed by three liberals who tried to disrupt and create havoc at a Trump campaign rally in March 2016. From the platform, candidate Trump told his supporters to ‘get ‘em out of here’. When they did, a physical melee erupted and the three protesters claimed that they were assaulted because of what Trump said.
As result of their own intentions to disrupt and create havoc at the rally, the three men are now suing Trump for ‘incitement, vicarious liability, negligence, gross negligence, and recklessness’.
Judge Hale denied most of the motions made by Trump’s attorneys to dismiss the charges. He stated that when Trump told his supporters to get them out of there that he was ‘particularly reckless’. Part of that decision was made when one of the people that actually assailed the protesters, in this case a black woman, was a white nationalist who testified that he only began pushing the protesters after hearing Trump say to get them out of there. In his ruling, Judge Hale wrote:
“It is plausible that Trump’s direction to ‘get ‘em out of here’ advocated the use of force. It was an order, an instruction, a command…Trump’s statement at least implicitly encouraged the use of violence or lawless action.”
Was it Trump’s fault that some white nationalists, known for their racism were attending the campaign rally? Was it Trump’s fault that the liberal protesters showed up and tried to disrupt the rally?
Evidently, Judge Hale believes it is.
This makes as much sense as when a family sued the State of Arizona and the Arizona Game and Fish Department for failure to control their wildlife. They were camping near a lake in central Arizona when a mountain lion, suffering from rabies, attacked their camp and injured their son.
But then when you realize that Judge David Hale is a Kentucky Democrat who was appointed by Barack Obama to serve as the United States Attorney for the Western District of Kentucky and then Obama appointed him to the United States District Court for the Western District of Kentucky. He is still a loyal Obamanite Democrat who has allowed his far left liberal political views cloud his legal judgement.
Trump is no more responsible for the actions taken by extremists attending the rally than the Arizona Game and Fish Department was responsible that a wild mountain contracted rabies and attacked a family camping out in the wild. In the Arizona case, the judge could barely keep a straight face as he threw out the lawsuit and hopefully another judge will do the same thing as this ridiculous political driven nonsense lawsuit moves through the courts.
